Terms of Service
  • Blue One Communications, Inc. grants you, the Member [which constitutes dial-up access, any broadband access, virtual domain hosting, server co-location, or any other service provided by Blue One Communications, Inc.] a non-exclusive, non-transferable right to access, use and display our services on any machine(s) of which you are the primary user. Unlimited access does not entitle a Member to a full time or dedicated connection. Blue One Communucations, Inc. services is provided on an AS IS, AS AVAILABLE BASIS. NO WARRANTIES OF ANY KIND, EITHER EXPRESSED OR IMPLIED, INCLUDING BUT NOT LIMITED TO, WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. NO ORAL ADVICE OR WRITTEN INFORMATION GIVEN BY Blue One Communications, Inc., IT'S EMPLOYEES OR THE LIKE, SHALL CREATE A WARRANTY OF ANY TYPE. It is also understood that Member may be subject to Terms of Service or the like on other pay or free sites as listed there.
  • Blue One Communications, Inc. will provide up to 50mb of space on a hard drive for the sole purpose of web page development of a personal nature for any Member who is currently enrolled as an "unlimited plus" customer. Such pages are intended for personal use, but other uses are not prohibited provided download traffic of 100mb is not exceeded (page will immediately be removed should this occur). Blue One Communications, Inc. provides virtual hosting, server co-location, and other services to customers on an as quoted basis. These clients or customers agree to follow and abide by the terms established when services are initiated. Blue One Communications, Inc. IS IN NO WAY RESPONSIBLE, DIRECTLY OR INDIRECTLY, FOR ANY LOST INCOMES OR INTERRUPTIONS OF SERVICE WHICH MAY AFFECT SUCH WEB SITES, NOR IS Blue One Communications, Inc. RESPONSIBLE FOR MAINTENANCE, BACKUP, OR CONTENT OF SUCH PAGES. Such pages may not contain content of adult nature, any illegal activities, nor links to such.
  • Blue One Communications, Inc. will provide free technical support to establish the initial working connection from Member's computer to Blue One Communications, Inc. and onto the internet. In terms of virtual hosting, server co-location, and other as quoted services, support to establish the service is guaranteed as well.  These means of this support are at the sole discretion of Blue One Communications, Inc. staff.
  • Member is responsible for all telephone charges, as well as providing computer equipment (including modem), telephone lines, and any other device(s) necessary to make the appropriate connection.
  • Member certifies that he/she is not a minor (and that any minor using account is under the supervision of the account holder, and as such Member accepts full responsibility for the minor's actions). Blue One Communications, Inc. memberships and/or solutions are NOT transferable.
  • Member agrees to pay all charges on a month-to-month basis. If Member is enrolled in "auto-billing" the concurrent billing cycle indicates acceptance of each pre-paid month's service. Member may cancel BEFORE the end of each billing cycle. Cancellation is effective at the end of the current month period and refunds are NOT given for a prorated month. In addition, if Member pre-paid in order to receive a discount, cancellation voids any discount and time used will be calculated based upon "full price" amount and refund issued accordingly.
  • Blue One Communications, Inc. may change current billing rates or surcharges at any time upon 30 day notice. Blue One Communications, Inc. may reduce any such fees WITHOUT notice to members. In the event Member's account is terminated, for any reason deemed appropriate by management, any credits or time are not convertible to cash or any other form of credit. In addition, any discounts, promotions, or granted time are not convertible to cash upon cancellation request of Member.
  • Blue One Communications, Inc. is a PRE-PAY service. If at any time payment is not made, credit card charge is declined, or check is returned by bank, Memberís account will IMMEDIATELY BE DEACTIVATED. NON-PAYMENT OF THIS SORT IS SUBJECT TO COLLECTION EFFORTS AND LAW ENFORCEMENT AS APPROPRIATE. Repeated problems of this nature will be cause for rejection from a pre-pay nature and/or loss of additional solutions. Although, billing cycle will not continue during de-activation of your account.
  • Member expressly agrees not to use Blue One Communications, Inc. in a manner that is prohibited by any law or regulation or to facilitate the violation of any law or regulation. Member also agrees to use said services in a manner that will not disrupt the enjoyment of others. Prohibited conduct includes, but is not limited to, use of Service to invade the privacy of others, impersonation of Blue One Communications, Inc. staff, harassment of others (including profane, libelous, slanderous or threatening material). Member also agrees NOT to use Blue One Communications, Inc. to violate or tamper with the security of Blue One Communications, Inc. or other services, or attempt to utilize another Member's account name. Nor may Member use Blue One Communications, Inc. service, equipment or e-mail address in connection with sending of the same or substantially similar unsolicited electronic message, commercial or not, to a large number of recipients (including mass mailings from another service which in any way implicates use of Blue One Communications, Inc.). Such use is subject to $200 per day fine and/or other legal remedies.
  • Either Blue One Communications, Inc. or Member may choose to terminate this Agreement at any time. Blue One Communications, Inc. may also restrict, suspend or terminate without notice for any breach of this agreement. Blue One Communications, Inc. reserves the right to refuse further service from Member, family member or further resident of household upon these circumstances. Upon termination of Agreement by either party, all services, files, email, etc. are no longer accessible by Member.
  • Member agrees to defend, indemnify and hold harmless Blue One Communications, Inc., it's owners, employees, agents and licensees from any claims and expenses, including reasonable attorney fees, arising out of or relating to Member's use of Blue One Communications, Inc.
  • The terms of this agreement governs Memberís use of anything provided by Blue One Communications, Inc. or affiliates. These terms cover the use of the online service offered by Blue One Communications, Inc. as well as other privately owned online services, private networks, other pay services and any other communications outlets provided via the Internet. 

If any portion of this agreement is unacceptable, you may cancel your account within 24 hours of startup, or 24 hours of notification of modifications. 

Your continued use of Blue One Communications, Inc. shall be conclusively deemed an acceptance of all terms, and modifications.
